Prior to filing bankruptcy under any of the
Chapters, a credit counseling course is required. The Bankruptcy Abuse
Prevention and Consumer Protection Act of 2005 requires those filing
bankruptcy to obtain credit counseling from an approved agency in the six
months immediately prior to filing bankruptcy. A certificate of completion
obtained from the credit counseling service must be submitted with the
bankruptcy petition. In addition, a financial counseling must be taken
after the filing of the bankruptcy petition. A debtor’s bankruptcy will
not closed until a certificate of completion is filed.
The cost for the counseling courses varies -- from a low $20 to much
higher. Some counseling agencies provide online counseling, meaning that
one can complete the counseling requirement online and receive a
certificate of completion by mail or online. Telephone service and person
to person service is also available.
The list of approved credit counseling agencies is always changing, with
counseling services being added and deleted on a regular basis. To find a
