Nullity of marriage

A Nullity of Marriage is a proceeding that if granted by the Court, it will terminate your marriage as though it never existed (ie. As though you were never legally married).  It restores the parties to an unmarried state.  Although the Court does not easily grant such a proceeding, it will do so if certain conditions are met and proven.  Those conditions are set forth below.

WHAT CONDITION MUST BE MET IN ORDER TO NULLIFY A MARRIAGE?

 

To receive a Judgment of Nullity you must prove to the court one of the following:

 

             • That the marriage was one of incest.

             • You were not 18 years of age at the time of marriage and did not live as husband and wife after becoming 18.

             • One of the parties was married to another person at the time of the marriage.

             • One of the parties committed fraud upon the other before the marriage and the subject of the fraud was a basis for the marriage.

             • Consent to the marriage was obtained by force.

             • One of the parties, at the time of the marriage, was physically incapable of entering into the marriage state.

 

             Further, you must also prove that you did not live as husband and wife for an extended period of time after learning of any of the above situations
