DISCRIPTIONS OF THE ABOVE:
• Marital Settlement Agreements are similar to contracts entered between parties in a divorce or legal separation. Entering such an agreement both parties compromise into a settlement on all issues regarding division of community and separate property, spousal support, child custody, child visitation, child support, and other matters of concern.
• Stipulations are also types of agreements between the parties that when signed by the Judge it becomes a temporary order pending the final order by Judgment. Stipulation can be used in divorces, Legal Separation, Order to Show Cause on specific issues regarding division of community and separate property, spousal support, child custody, child visitation, child support, and other matters of concern.
• Child Support Calculation is a program known as Dissomaster that gives the amount one party will to pay for child support . The amount of support is determined by both parties monthly income and the percentage of time each party spends with the minor child(ren). The same calculation program also determines the amount one party is to pay for spousal support.
• Findings After Hearing is an order prepared after an Order to Show Cause hearing. In order to have the Judge’s decision become an order a Findings After Hearing should be filed. The Findings After Hearing is drafted by either party within the action and mirrors the judge’s decision. Usually said document is presented to the opposing party for their review prior to its court filing
• Qualified Domestic Relations Order (QDRO) are orders regarding the division of a pension or retirement fund resulting from a divorce or legal separation. The document is usually drafted after entry of the final judgment of a divorce or legal separation proceeding. Once the order is signed by the judge, said order directs the administrator of the pension or retirement fund to dispurse to the other spouse his/her court ordered portion of said funds.
